This Privacy Policy was prepared by Osaka Gas (Thailand) Co., Ltd. (hereinafter referred to as the "Company") to protect the personal data of all users, who access the Company's website (https://www.ogt.co.th) as follows:

1.1 Personal data, such as first and last names;

1.3 Data of device or tool and technical data, such as IP address, MAC address, Cookie ID, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access our website; and

1.4 Other information, such as website usage, and any other information that is subject to the definition of the personal data under the Personal Data Protection Act of 2019 (hereinafter referred to as the “PDPA”).

2. Use of the Personal Data

2.1 The Company will conduct the Data Processing of your Personal Data as necessary and as permitted by PDPA only for any or all of the following circumstances:

  • When the Company needs to contact you for offering the service or providing information or marketing communications;

  • When the Company needs to perform the contract with you or take steps to enter into a contract at your request;

  • When it is necessary for the Company’s legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests, such as to use data analytics to improve our website; and

  • Regulators and governmental authorities;

If such change happens to our business, then the new owners may use your Personal Data in the same way as set out in this Privacy Policy.

2.3 The Company hereby certifies that your Personal Data collected by the Company will not be disclosed to other third parties without obtaining your permission.

3. Cross-border transfer of the Personal Data

The Company may send or transfer the Personal Data to Japan where the Osaka Gas Group is located or to any other destination outside Thailand. However, in some cases, the personal data protection standard in the destination country may not be adequate as required by the authority under the PDPA.

The Company may improve or revise the Privacy Policy without prior notice to you for the suitability and efficiency in providing the services or to reflect changing of laws, or operational requirements.

8.2 Right to access

You have the right to request for the access and copy of the Personal Data which are under the control of the Company. Also, if the Personal Data has been collected without your consent, you have the right to request for the disclosure of the acquisition of such Personal Data. However, any of the above-mentioned request may be refused if it is permitted under the law or court order or the exercise of such right may cause damage to rights and freedom of other persons.

 

8.3 Right to request the portability

You have the right (i) to request that the Company transfers the Personal Data to other data controller if it can be done by the automatic means or (ii) to request for the Personal Data in such formats that the Company sends or transfers to other data controller unless it is impossible to do so due to technical circumstances.

8.5 Right to request the erasure, destruction and anonymization

You have the right to request the Company to erase, destruct, and anonymize the Personal Data under certain circumstances as prescribed in the PDPA.

8.6 Right to request the suspension of use

You have the right to request that the Company suspends the use of the Personal Data under certain circumstances as prescribed in the PDPA.

8.7 Right to request the update

You have the right to request the Company to ensure the Personal Data remains accurate, up-to-date, complete and not misleading.

 

8.8 Right to lodge the complaint

You have the right to lodge the complaint to the relevant official authority under the PDPA of the violation of the PDPA by the Company and the employees or sub-contractors thereof.
